This page explains what we do with personal information you give us through this website. It is written to meet section 18 of the Protection of Personal Information Act 4 of 2013 (POPIA).

We are the responsible party for the personal information described on this page.

What we collect

Through the contact form: your name, your company, your email address, your phone number, and whatever you write in the message box.

That last one is worth a note. The message field is free text — whatever you type into it, we receive and we keep. Please don't put anything in there you wouldn't want sitting in an inbox: ID numbers, account numbers, passwords, credentials, health or financial details. If you need to send us something sensitive, ask us first and we'll arrange a proper channel for it.

If you email us directly at hello@fusiongroup.co.za, we receive your email address, your name if your mail client sends it, and the contents of your message. This page covers that too.

Server logs. Our web server records standard logs — the IP address of visitors, the pages requested, and the time of the request. They are kept for 30 days and used to keep the site running and to investigate abuse.

Why we collect it

To read your enquiry, reply to it, and — if it goes further — to quote and contract with you. That's the whole purpose. We don't do anything else with it.

Do you have to give it to us?

No. Using the form is voluntary.

We need your name, your email address and your message, because we can't answer you without them. Company and phone number are optional. If you leave out something we need, we can't reply, and that's the only consequence. If you'd rather not use the form at all, email or phone us.

Our legal grounds

We process your enquiry because it is necessary for our legitimate interests and yours — you asked us something and we want to answer it (section 11(1)(f) of POPIA). Where an enquiry turns into work, we process it because it is necessary to conclude and perform a contract with you (section 11(1)(b)).

We are not relying on your consent. That means you don't have to give any, and submitting the form doesn't sign you up to anything. It also means you have a right to object to our processing at any time — see Your rights.

Who else handles it

• Microsoft. The form delivers into a shared mailbox in our Microsoft 365 tenant through the Microsoft Graph API, and Microsoft hosts our email. Microsoft acts as our operator: they process this information on our instruction, under Microsoft's Products and Services Data Protection Addendum.
• Google. This site loads its typefaces from Google Fonts. That discloses your IP address and basic browser information to Google when the page loads. We do not send Google anything you type into the form.

We don't sell personal information. We don't share it with anyone else unless you ask us to, or the law requires it of us.

Where it goes

We are a South African business and so is our work. Some of the services we rely on are operated by companies based elsewhere.

Our Microsoft 365 tenant is provisioned in [CONFIRM ACTUAL REGION]. Microsoft's product terms commit them to storing our mailbox content at rest within that region. Microsoft is a global company, and some processing — support, diagnostics, routing — may still happen outside South Africa. That transfer is covered by Microsoft's Data Protection Addendum, a binding agreement providing protection substantially similar to what POPIA requires, as section 72(1)(a) allows.

Google Fonts is served from Google's global network, so the IP disclosure described above leaves South Africa.

How long we keep it

Enquiries that don't become work: 24 months from our last contact with you. Then we delete them.

If we end up working together: for as long as we are working together, and afterwards for as long as the law requires us to keep business and tax records.

You can ask us to delete your enquiry sooner than that. If we are not required to keep it, we will.

How we protect it

The form is submitted over an encrypted connection. It is delivered into a mailbox that only [NUMBER / ROLE] can open. Every account on our Microsoft 365 tenant requires multi-factor authentication.

This is the same standard we hold our clients' systems to.

If personal information in our care is ever compromised, we will notify the Information Regulator and the people affected, as section 22 of POPIA requires.

Cookies and analytics

This site sets no cookies. It runs no advertising pixels and no cross-site tracking. There is nothing here to opt out of.

Marketing

We won't add you to a mailing list because you sent us an enquiry. If we ever want to send you marketing, we will ask you first.

Your rights

Under POPIA you can:

• Ask what we hold about you — the personal information itself or a description of it, and who has had access to it (section 23).
• Ask us to correct or delete it (section 24).
• Object to our processing it (section 11(3)(a)).
• Complain to the Information Regulator (see below).

To do any of the first three, email hello@fusiongroup.co.za. Tell us what you want and enough about yourself for us to find your record. We will reply within 30 days.

Correcting or deleting your information is free. A formal request under the Promotion of Access to Information Act may attract the fees that Act prescribes — but we would rather just deal with your email.
